It’s important to understand the history of the concept of the Rule of Law in order to understand how it works in modern society.

In the modern conception of the Rule of Law, procedural principles matter more than substantive principles. For example, during the debate over whether Guantanamo Bay was legal, people were concerned with the detention of detainees. They demanded an opportunity to appear before a legal tribunal, answer evidence and have legal representation.

In liberal political morality, the rule of law is one of many ideals, alongside democratic institutions, human rights, social justice, and economic freedom. This plurality of ideals indicates that a society should be evaluated in many ways. Although some legal philosophers claim that the Rule of Law should be separate from democracy, others have argued that the two are inextricably linked.
